Supervisor DeSena offered the following resolution and moved its adoption, which resolution was declared adopted after a poll of the members of this Board:

RESOLUTION NO. 260 - 2024

A RESOLUTION AUTHORIZING TRANSFERS FROM THE TOWN OF NORTH HEMPSTEAD HIGHWAY FUND AND SIDEWALK DISTRICT INSURANCE RESERVE FUND.

WHEREAS, the Town Board (the “Board”) of the Town of North Hempstead (the “Town”) has established an Insurance (TORT) Highway Fund Reserve Fund (the “Highway Fund Reserve”) (DA.0889.001) and a Sidewalk Insurance (Tort) Sidewalk District Reserve Fund (the “Sidewalk District Reserve”) (SM017.0889.001) for its special Sidewalk District (the Highway Fund Reserve and the Sidewalk District Reserve are jointly the “Funds”); and

WHEREAS, the Town desires to use moneys from the Funds in order to pay the cost of settlements approved by this Board pursuant to Resolution No. 204-2024, duly adopted April 4, 2024; and

WHEREAS, pursuant to Town Law §§ 112 and 113, the Board desires to transfer $423,203.14 from the Highway Fund Reserve, and to transfer $190,000 from its Sidewalk District Reserve in order to fund the previously approved settlements (the “Transfers”); and

WHEREAS, after careful consideration, the Board finds it in the best interests of the Town to authorize the Transfers.

NOW, THEREFORE, BE IT

RESOLVED that the Board hereby authorizes the Transfers outlined above as follows:

; and be it further

RESOLVED that the Offices of the Town Attorney and Comptroller are hereby directed to take such action as may be necessary to effectuate the foregoing.
