Supervisor DeSena offered the following resolution and moved its adoption, which resolution was declared adopted after a poll of the members of this Board:

RESOLUTION NO. 244 - 2024

A RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDMENT TO AN AGREEMENT WITH ENECON NORTHEAST FOR THE REPAIR OF THE DANCE FLOOR AT THE NORTH HEMPSTEAD "YES WE CAN" COMMUNITY CENTER, NEW CASSEL.

WHEREAS, pursuant to Resolution No. 78-2024, duly adopted on February 6, 2024, the Town of North Hempstead (the “Town”) entered into an agreement with Enecon Northeast A.P.S., Inc., 150 Schmitt Boulevard, Farmingdale New York 11735 (the “Contractor”) for the repair of the dance floor at the “Yes We Can” Community Center (the “Services”) in consideration of an amount not to exceed Forty-Two Thousand Three Hundred Sixty and 00/100 Dollars ($42,360.00) (the “Original Agreement”); and

WHEREAS, the Commissioner of the Department of Parks and Recreation (the “Commissioner”) has recommended that the Town amend the Original Agreement to account for additional work performed by the Contractor not included within the scope of the original proposal, involving the encapsulation of the existing steel floor mounts supporting the ballet bar necessitated by spacing discovered upon removal of the old floor, thereby increasing the contract amount under the Original Agreement by an amount not to exceed Four Thousand Nine Hundred Fifty and 00/100 Dollars ($4,950.00) (the “Amendment”); and

WHEREAS, the Town Board finds it in the best interests of the Town to authorize the Amendment.

NOW, THEREFORE, BE IT

RESOLVED that the Amendment be and hereby is authorized; and be it further

RESOLVED the Supervisor or her designee is authorized and directed to execute, on behalf of the Town, the Amendment, all as more particularly set forth in a copy of the Amendment, which shall be on file in the Office of the Town Clerk; and be it further

RESOLVED that the Office of the Town Attorney be and hereby is authorized and directed to negotiate and supervise the execution of the Amendment; and be it further 

RESOLVED that the Comptroller be and hereby is authorized and directed to pay the costs of the Amendment upon receipt of duly executed Amendment and certified claims therefor.
