Councilperson Liu offered the following resolution and moved its adoption, which resolution was declared adopted after a poll of the members of this Board:

RESOLUTION NO. 122 - 2024

A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH LONG ISLAND GROWERS MARKET LLC FOR A FARMERS MARKET AT CLINTON G. MARTIN PARK, NEW HYDE PARK.

WHEREAS, the Town of North Hempstead (the “Town”) owns certain real property know as Clinton G. Martin Park (the “Park”) in New Hyde Park; and


WHEREAS, the Town owns and operates the Park for the use and enjoyment of Town residents; and


WHEREAS, the Long Island Growers Market LLC, 35870 Main Road, Orient, New York 11957 (the “Licensee”) has requested a license to use a portion of the parking lot at the Park to operate a farmers market on Fridays from 7:00am until 1:00pm between June 1, 2024 and November 30, 2024 (the “Use”) (the “Agreement”); and 


WHEREAS, the Commissioner of the Town’s Department of Parks and Recreation has recommended that the Town grant the Licensee a license for the Use (the “License”) and authorize the execution of an agreement with the Licensee for the License (the “License Agreement”); and


WHEREAS, this Board wishes to grant the License and to authorize the Town to execute the License Agreement for the License.


NOW, THEREFORE, BE IT


RESOLVED that the License be and is hereby granted; and be it further


RESOLVED that the License Agreement be and hereby is authorized; and be it further


RESOLVED that the Supervisor or her designee be and is hereby authorized to execute on behalf of the Town, the Agreement, a copy of which will be on file in the Office of the Town Clerk; and be it further


RESOLVED that the Office of the Town Attorney be and is hereby authorized and directed to negotiate and supervise the execution of the Agreement; and be it further


RESOLVED that the Supervisor or Deputy Supervisor is authorized take such other action as may be necessary to effectuate the foregoing.
