Supervisor Bosworth offered the following resolution and moved its adoption, which resolution was declared adopted after a poll of the members of this Board:

RESOLUTION NO. 246 - 2018

A RESOLUTION AUTHORIZING THE USE OF AGREEMENTS FOR VARIOUS PRODUCTS AND SERVICES LET BY NASSAU BOCES AND EASTERN SUFFOLK BOCES.

        WHEREAS, the Town wishes to participate in Cooperative Bidding Programs (the “Programs”) conducted by the Board of Cooperative Educational Services of Nassau County (“Nassau BOCES”) and by the Board of Cooperative Educational Services, First Supervisory District of Suffolk County (“Eastern Suffolk BOCES”) for the purchase of various commodities and/or services as authorized by and in accordance with the Education Law and General Municipal Law Section 119-o; and

 

        WHEREAS, the Town is a municipality within the meaning of General Municipal Law § 119-n and is eligible to participate in the Nassau BOCES and Eastern Suffolk BOCES Programs in the areas mentioned above; and

 

        WHEREAS, the Town acknowledges receipt of the Program descriptions inclusive of Nassau BOCES and Eastern Suffolk BOCES standard bid packets and the general conditions relating to the Program; and

 

        WHEREAS, with respect to all activities conducted by the Programs, the Town wishes to delegate to Nassau BOCES and Eastern Suffolk BOCES the responsibility for drafting bid specifications, advertising for bids, accepting and opening bids, tabulating bids, awarding bids, and reporting the results to the Town; and

 

        WHEREAS, the Board wishes to authorize and direct the Supervisor or the Deputy Supervisor, or their designees, as the case may be, to execute any documentation necessary to participate in the Programs on behalf of the Town.

 

        NOW THEREFORE BE IT

 

        RESOLVED that the Town hereby appoints Nassau BOCES and Eastern Suffolk BOCES as its representatives and agents in all matters related to the Programs, including, but not limited to,  responsibility for drafting of specifications, advertising for bids, accepting and opening bids, tabulating bids, reporting the results to the Town and making recommendations thereon; and be it further

 

        RESOLVED that the Town hereby authorizes Nassau BOCES and Eastern Suffolk BOCES to place all legal advertisements for any required cooperative bidding in Newsday, which is designated as the official newspaper for the Programs; and be it further

 

        RESOLVED that Nassau BOCES and Eastern Suffolk BOCES are hereby authorized to award cooperative bids on behalf of the Town to the bidder deemed to be the lowest responsible bidder meeting the bid specifications and otherwise complying with Article 5-A of the General Municipal Law of the State of New York relating to public bids and contracts and to enter into contracts for the purchase of the commodities and/or services as authorized herein; and be it further

 

        RESOLVED, that the Town hereby authorizes its Director of Purchasing or his/her designee on behalf of the Town to participate in cooperative bidding conducted by Nassau BOCES and Eastern Suffolk BOCES and if requested to furnish Nassau BOCES or Eastern Suffolk BOCES an estimated minimum number of units that will be purchased and such other documents and information that may be reasonably necessary or useful in conducting the Program; and be it further

 

        RESOLVED that the Town’s participation in the Program shall be for a term of one (l) year as authorized by General Municipal Law §119-0.2.j; and be it further

 

        RESOLVED that the Town agrees to pay Nassau BOCES a fee of Four Hundred and 00/100 Dollars ($400.00) per bid participated in, as established and/or assessed, by Nassau BOCES to act as the lead agent for the Program; and be it further

 

        RESOLVED that the Town agrees to pay Eastern Suffolk BOCES a fee of Five Hundred Fifty and 00/100 Dollars ($550.00) per bid participated in, as established and/or assessed, by Eastern Suffolk BOCES to act as the lead agent for the Program; and be it further

 

        RESOLVED that the Supervisor or the Deputy Supervisor, or their designees, as the case may be, is hereby authorized to execute on behalf of the Town any agreements and documents necessary to participate in the Programs, and to take such related action as may be necessary to effectuate the foregoing; and be it further

 

        RESOLVED that the Office of the Town Attorney be and is hereby authorized and directed to negotiate the terms and conditions of such documents; and be it further

 

        RESOLVED that the Comptroller be and hereby is authorized and directed to pay the fee for Program participation upon receipt of duly executed agreement and certified claims therefor.
