Councilperson Russell offered the following resolution and moved its adoption, which resolution was declared adopted after a poll of the members of this Board:

RESOLUTION NO. 221 - 2018

A RESOLUTION REDUCING PERMIT FEES FOR THE NORTH HEMPSTEAD HOUSING AUTHORITY DEVELOPMENT PROJECT LOCATED AT THE SITE OF THE FORMER GRAND STREET SCHOOL, NEW CASSEL AND AUTHORIZING THE AUTHORITY TO MAKE APPLICATIONS ON BEHALF OF THE TOWN TO THE TOWN DEPARTMENT OF BUILDING SAFETY, INSPECTION AND ENFORCEMENT IN CONNECTION WITH THE PROJECT.

        WHEREAS, the North Hempstead Housing Authority (the “Authority”) is in the process of redeveloping the former Grand Street School in New Cassel (the “Property”); and

 

        WHEREAS, the redevelopment of the Property will provide affordable housing to low and moderate income individuals within the Town of North Hempstead; and

 

        WHEREAS, the Authority has requested that the Town reduce the cost of construction by reducing the building permit fees charged or to be charged for the development to an amount equal to 35% of the amount required by the Town Code (the “Reduced Permitting Fees”); and

 

        WHEREAS, the Authority has also requested that it be permitted to defer the payment of the Reduced Permitting Fees until the closing of a tax credit financing transaction involving the State of New York (the “State”); and

 

        WHEREAS, the Authority has also requested that it be permitted to execute on the Town’s behalf any applications for Permits; and

 

        WHEREAS, to pursue its policy goals of creating affordable residential units for

low and moderate income families, the Board wishes to direct the Department of Building Safety, Inspection and Enforcement (the “Building Department”) to charge Reduced Permitting Fees for the redevelopment of the Property and to allow the payment of such fees to be deferred until the closing of the tax credit financing transaction with the State.

 

        NOW, THEREFORE, BE IT

 

        RESOLVED that the Town Board hereby authorizes the Building Department to charge the Reduced Permitting Fees for the redevelopment of the Property; and be it further

 

        RESOLVED the payment of the Reduced Permitting Fees be deferred until the closing of the tax credit financing transaction with the State of New York; and be it further

 

        RESOLVED that the Authority be and hereby is authorized to execute, on the Town’s behalf, any applications necessary to obtain permits and other approvals for the development from the Building Department; and be it further

 

        RESOLVED that the Commissioner of the Building Department is hereby authorized to take such other action as may be necessary to effectuate the foregoing.
